Practice Areas: MVA Hearings
    Being faced with the suspension or revocation of your driver's license is a very serious matter. In today's world, the practical consequences of not having a license range from an inconvenience to dire economic consequences, such as losing a job due to not being able to drive in your employment or not being able to get to your job. Since having a license is a quasi-property right, you generally have the right to a hearing before an Administrative Law Judge, who is an independent Judge of the Office of Administrative Hearings, and not an employee of the MVA. Legal concepts and terms you would likely need to know include the substantive elements of the law relating to the reason for the suspension or revocation, the procedural steps involved with defending against the suspension or revocation, what facts the MVA must show for a person to be subject to a suspension or revocation, the burden of proof on the MVA at the hearing, and what the Judge may consider in mitigation of the consequences sought by the MVA. How these legal concepts interrelate to each other is also important.

    It can be quite confusing and complicated. Do you know the law? Do you know how the law applies to the facts of your case? Do you know the rules of evidence?
